Terms of Service

These Terms of Service ("Terms") govern the use of the tour and transfer operations management software ("Service") provided by PickupTime (pickuptime.io) ("PickupTime", "we", "us") at pickuptime.io. By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

"Operator" means the tour or transfer business that subscribes to the Service and operates its own workspace (tenant); "Driver" means an individual registered to the Service by an Operator whose device transmits location data during trips; "Guest" means a passenger to whom the Operator provides transport services and whose details are entered into the Service by the Operator; "Trip" means a pickup run planned within the Service.

2. Scope of the Service

PickupTime is a multi-tenant SaaS platform that provides: planning of morning pickup runs; live location sharing from drivers' phones strictly during an active trip; personal tokenized tracking links for Guests; AI-assisted OCR of vehicle registration documents to populate vehicle records; and notifications delivered via WhatsApp links and email. The Service is provided on an "as is" basis. PickupTime is not a party to the Operator's transport activity and assumes no responsibility for the transport services themselves.

3. Accounts and Free Trial

You are responsible for the accuracy of the information you provide when creating an account, for safeguarding your credentials, and for all activity that occurs under your account. New Operators receive a 14-day free trial with no credit card required. If a paid plan is not selected by the end of the trial, the account may be placed in read-only mode or suspended.

4. Subscription Plans and Fees

Fleet plan: USD 9.99 per vehicle per month, all features included; online signup covers up to 25 vehicles. For fleets exceeding 25 vehicles, contact us; the per-vehicle price stays the same and only onboarding and invoicing are arranged by contract. Fees are billed monthly in advance. Price changes will be announced at least 30 days in advance and take effect from the next billing cycle. Applicable taxes are not included in the listed prices. Fees for unused periods are non-refundable, except where mandatory consumer protection law provides otherwise.

5. Operator Responsibilities

The Operator is solely responsible for: (a) the accuracy and currency of Guest data entered into the Service (name, hotel, contact details); (b) having a valid legal basis (contract, consent or legitimate interest) for collecting Guest contact information and processing it through PickupTime, and for providing Guests with any legally required notices; (c) compliance with all employment, social security, professional licensing and driver documentation laws applicable to the Drivers it registers; and (d) informing Drivers about the processing of their location data and obtaining their consent where required. PickupTime does not review or verify the content of data entered by Operators.

6. Acceptable Use

You may not use the Service: (a) in violation of applicable law; (b) in a manner that infringes the rights of third parties; (c) in a way that damages, overloads or circumvents the security of the Service's infrastructure; (d) for unauthorised access, reverse engineering or automated scraping; or (e) by sharing Guest tracking links with unrelated third parties in a manner that violates individuals' privacy. The Operator is responsible for ensuring that notifications sent via WhatsApp comply with the platform's rules and applicable anti-spam legislation.

7. Service Levels

No uptime commitment is given for the current version of the Service. PickupTime will use commercially reasonable efforts to keep the Service available and will announce planned maintenance in advance where practicable. GPS accuracy depends on device hardware, network coverage and environmental conditions; PickupTime does not warrant the precision of location data.

8. Intellectual Property

All software, designs, trademarks and other intellectual property in the Service belong to PickupTime. The Operator is granted a non-exclusive, non-transferable licence to use the Service for the duration of its subscription. Data entered into the Service by the Operator remains the Operator's property; PickupTime processes such data solely to provide the Service.

9. Limitation of Liability

To the maximum extent permitted by mandatory law, PickupTime shall not be liable for loss of profit, loss of data, loss of goodwill or any indirect or consequential damages. PickupTime's aggregate liability arising out of or in connection with these Terms shall in all cases be limited to the total subscription fees paid by the relevant Operator in the 12 months preceding the event giving rise to liability. This limitation does not apply to liability arising from wilful misconduct or gross negligence, nor to non-waivable statutory consumer rights.

10. Suspension and Termination

The Operator may terminate its subscription at any time with effect from the end of the current billing period. PickupTime may suspend the account or terminate these Terms on written notice in the event of non-payment, material breach of these Terms, or unlawful use. Upon termination, Operator data will be deleted or returned in accordance with the timelines and procedures set out in the Data Processing Addendum.

11. Changes to These Terms

PickupTime may update these Terms. Material changes will be announced at least 15 days in advance by email or in-app notice. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. The Courts and Enforcement Offices of Nevşehir, Türkiye shall have jurisdiction over disputes arising from these Terms. Nothing in this clause deprives users who qualify as consumers of the protection of mandatory rules of the law of their habitual residence, or of their right to bring proceedings before consumer arbitration boards and consumer courts where applicable.
